05 Health information

Information concerning health is regarded as special-category personal data under the General Data Protection Regulation (GDPR) and receives additional protection.

Where AgeWell processes health information, it will only do so where there is an appropriate lawful basis under Article 6 GDPR and an applicable condition under Article 9 GDPR.

We seek to collect and use only the health information reasonably necessary to provide the relevant service and handle such information with appropriate confidentiality and security.

06 Information about another person

A family member or another person may sometimes contact AgeWell or arrange a consultation concerning an older person.

If you provide information about another person, you should only provide information that is reasonably necessary and that you are entitled to share.

AgeWell respects the privacy, confidentiality, autonomy and rights of the person concerned.

Booking or attending a consultation concerning another person does not automatically give someone the right to access that person’s confidential information or make decisions on their behalf.

Where consent, authority or decision-making capacity is relevant, this will be considered in accordance with applicable law and professional obligations.

07 General enquiries

Please protect your privacy.
Do not send detailed medical records or unnecessary sensitive health information through our general website enquiry form, social-media accounts or other general communication channels.

Our general enquiry form is intended to help us understand your enquiry and identify the AgeWell service that may be appropriate.

08 Service providers

AgeWell may use trusted third-party service providers to help operate its website and services. Depending on the services in use, these may include providers for:

  • Appointment scheduling
  • Payment processing
  • Email and business communications
  • Online consultations
  • Website hosting and management
  • Pre-consultation forms
  • IT and security services
  • Accounting, legal and other professional services

These providers may process personal information in accordance with their respective roles and applicable data-protection requirements.

Where a provider processes personal information on our behalf, appropriate data-processing arrangements will be used where required.

09 International transfers

Some service providers may process or store personal information outside Ireland or the European Economic Area (EEA).

Where personal information is transferred internationally, appropriate safeguards will be used where required by applicable data-protection law.

10 How long we keep information

We keep personal information only for as long as reasonably necessary for the purposes for which it was collected, taking account of applicable legal, professional, accounting, insurance and dispute-resolution requirements.

Different types of information may therefore be retained for different periods.

When information is no longer required, it will be securely deleted or otherwise disposed of in accordance with our retention practices.

Important information about using the AgeWell Nursing Consultancy website and our consultation services.

These Terms & Conditions apply to the use of the AgeWell Nursing Consultancy website and, where applicable, the purchase and use of AgeWell consultation services.

By booking a consultation, you agree to these Terms together with our Privacy Policy and Consultation, Cancellation & Refund Policy.

Nothing in these Terms limits rights that cannot lawfully be excluded under Irish consumer law.

01 About AgeWell

AgeWell Nursing Consultancy provides independent nursing education, guidance and care navigation, primarily for older people and their families.

The service is delivered online.

AgeWell is not an emergency service.
Our service does not replace your GP, consultant, hospital team, emergency services or other treating healthcare professional.

02 Professional services

Consultations are provided by Caroline Broderick, a registered nurse with extensive experience in older-person care.

Professional nursing services are provided in accordance with applicable professional obligations and standards.

Registered nurses providing healthcare remotely remain subject to applicable professional standards and requirements.

03 Eligibility

The person making and paying for a booking must be at least 18 years old and legally capable of entering into a contract.

The service is intended primarily for adults.

Our online consultation service is intended for people located in the Republic of Ireland at the time of the consultation, unless AgeWell has expressly agreed otherwise in advance.

04 Consultations

Unless otherwise stated, AgeWell’s individual consultations are:

Consultations may be provided through Google Meet or another appropriate platform notified to you.

Different consultation types may have different prices. The applicable service description and total price will be displayed before you complete your booking.

05 Nature of the service

AgeWell provides education, guidance and care navigation based on the information available and the information provided during the consultation process.

A consultation may help you:

  • Better understand an issue
  • Organise your concerns
  • Consider questions to raise with healthcare professionals
  • Understand possible care or support pathways
  • Identify services or professionals that may be appropriate
  • Prepare for care-related conversations or decisions
AgeWell cannot guarantee a particular outcome.
The information and guidance provided will depend on the individual circumstances and the information available at the time.

06 Online-service limitations

An online consultation does not permit physical examination or direct clinical observation equivalent to an in-person assessment.

AgeWell may advise you to contact a GP, consultant, emergency service or another appropriate healthcare professional where an issue requires assessment or treatment beyond the scope of the AgeWell service.

07 Your responsibilities

When using our consultation service, you agree to:

  • Provide information honestly and to the best of your knowledge
  • Provide only information reasonably relevant to the consultation
  • Tell Caroline where information may be incomplete or uncertain
  • Attend the appointment at the agreed time
  • Have a suitable internet connection and compatible device
  • Participate from an appropriately private environment where possible
  • Seek appropriate medical care where advised or where symptoms require it
Do not use AgeWell as a substitute for urgent or emergency medical care.

08 Payment

Consultation prices are displayed before booking.

Payment is generally required in advance through our payment provider as part of the booking process.

A booking is confirmed once the required booking and payment process has been successfully completed and confirmation has been issued.

09 Cancellations & refunds

Cancellation, rescheduling, applicable statutory withdrawal rights and refunds are governed by our Consultation, Cancellation & Refund Policy.

Please review that policy before completing your booking.

10 Family bookings

You may book a consultation to obtain guidance relating to an older family member.

You should respect that person’s privacy and provide only information that you are entitled to share.

AgeWell will not disclose confidential information about another person merely because you are their relative or because you paid for a consultation.

11 Recording consultations

Clients must not audio-record, video-record or otherwise record a consultation without Caroline’s prior express agreement.

AgeWell will not routinely record consultations.

12 Intellectual property

Unless otherwise stated, content on the AgeWell website and materials created by AgeWell are owned by or licensed to AgeWell Nursing Consultancy.

Materials supplied to individual clients are generally provided for personal, non-commercial use.

They may not be reproduced, sold, published, distributed or commercially exploited without permission, except where permitted by law.

13 Website & social-media information

Information published on the AgeWell website and AgeWell social-media channels is general educational information.

Reading website content, following AgeWell on social media or interacting with social-media content does not itself create a nurse-client relationship or constitute an individual consultation.

14 External websites

AgeWell may provide links to organisations, services and external resources for information or convenience.

AgeWell does not control third-party websites and is not responsible for their content, availability, privacy practices or services.

The inclusion of a link does not necessarily constitute an endorsement by AgeWell.

15 Corporate & professional services

AgeWell may provide talks, professional education sessions, corporate training and other services to nursing homes, healthcare organisations and other organisations.

Corporate engagements may be subject to a separate proposal, quotation, contract or written terms.

Where separate written terms have been agreed for a corporate engagement, those terms will govern that engagement to the extent of any inconsistency with these general website Terms.

16 Complaints

If you are dissatisfied with an AgeWell service, please contact us so that we can consider your concerns fairly and appropriately.

17 Liability & statutory rights

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing in these Terms affects your mandatory rights under applicable Irish consumer law.

18 Governing law

These Terms & Conditions are governed by Irish law.

Any dispute will be dealt with subject to applicable Irish law and jurisdiction, without limiting any mandatory consumer rights concerning jurisdiction or dispute resolution.

Booking with confidence

Consultation, Cancellation & Refund Policy

Clear information about booking, changing or cancelling your AgeWell Nursing Consultancy appointment.

This policy explains AgeWell Nursing Consultancy’s booking, cancellation, rescheduling and refund arrangements for individual consultation services.

It should be read together with our Terms & Conditions.

Nothing in this policy excludes, restricts or replaces any statutory consumer rights that apply to you.

01 Booking & payment

AgeWell consultations are generally booked online and payment is required in advance unless otherwise agreed.

Your appointment is confirmed once the required booking and payment process has been successfully completed and confirmation has been issued.

Please check your booking confirmation carefully and contact us promptly if any of the appointment details appear to be incorrect.

02 Changing your appointment

We understand that plans can change. If you need to cancel or reschedule your consultation, please give us as much notice as possible.

Our standard cancellation period is 24 hours.
Where possible, please cancel or request to reschedule at least 24 hours before the scheduled start time of your consultation.

You can use the cancellation or rescheduling options provided with your booking confirmation, where available, or contact us directly.

Booking enquiries

03 Cancelling with at least 24 hours’ notice

Where you cancel at least 24 hours before the scheduled start time of your consultation, you may choose:

  • To reschedule to another available appointment at no additional charge; or
  • To receive a refund of the amount paid for the cancelled consultation to the original payment method.

These arrangements are provided in addition to any statutory cancellation or other consumer rights that apply to you.

04 Cancelling with less than 24 hours’ notice

Subject always to your statutory rights, where you cancel for a change-of-mind or other non-statutory reason less than 24 hours before the scheduled start time, AgeWell does not ordinarily provide a discretionary refund.

This is because the appointment time has been reserved specifically for you and may not reasonably be filled at short notice.

AgeWell may, at its discretion, offer rescheduling or a refund in exceptional circumstances.

Your statutory rights take priority.
The 24-hour policy does not remove or restrict any cancellation, refund or other remedy to which you are legally entitled.

05 Missed appointments

If you do not attend your consultation and have not cancelled beforehand, the appointment will normally be treated as a missed appointment.

Subject to applicable statutory rights, no discretionary refund will ordinarily be provided for a missed appointment.

If exceptional circumstances prevented you from attending, please contact AgeWell as soon as reasonably possible. Any discretionary rescheduling or refund will be considered on a case-by-case basis.

06 Late arrival

If you join your consultation late, Caroline will make reasonable efforts to provide the consultation during the appointment time remaining.

The consultation will ordinarily still finish at its originally scheduled end time so that subsequent appointments are not delayed.

Where a delay is substantial and prevents a meaningful or appropriate consultation from taking place, the appointment may be treated as missed.

07 If AgeWell cancels your appointment

If AgeWell is unable to provide your consultation at the agreed time and needs to cancel it, you will be offered your choice of:

  • Rescheduling to another available appointment at no additional charge; or
  • A full refund of the amount paid for the affected consultation.

AgeWell will make reasonable efforts to notify you as soon as possible if an appointment needs to be cancelled.

08 Statutory 14-day withdrawal rights

Where applicable under Irish consumer law, a consumer who enters into a service contract online generally has a statutory right to cancel the contract within 14 days from the day the service contract is entered into, without giving a reason.

This statutory right is separate from AgeWell’s standard 24-hour cancellation policy.
Where a statutory right to cancel applies, AgeWell’s 24-hour notice requirement does not override that right.

If you specifically request that AgeWell begins providing the service during the 14-day withdrawal period, the rules applying to cancellation may change once performance of the service has begun.

Where the service begins during the withdrawal period at your request and you subsequently exercise an applicable statutory right to cancel before the service has been fully performed, you may be required to pay an amount proportionate to the service already supplied, where permitted by law.

Where the service has been fully performed during the withdrawal period following the legally required prior express consent and acknowledgement, the statutory right to cancel may cease.

AgeWell will not seek to exclude or restrict a statutory withdrawal right except where permitted by law and the applicable legal requirements have been satisfied.

09 Refunds

Where a refund is due under this policy or applicable consumer law, AgeWell will process the refund without undue delay and within any timeframe required by law.

Where required by applicable consumer law, refunds will be made using the same payment method used for the original transaction, unless another method has been expressly agreed.

Once AgeWell has processed a refund, the time taken for the funds to appear in your account may depend on your bank or payment provider and is outside AgeWell’s control.

10 How to cancel

You can cancel your consultation using the cancellation link provided with your booking confirmation, where available, or by contacting AgeWell.

Your cancellation should clearly identify the name under which the appointment was booked and the appointment date and time.

Where you are exercising a statutory right to cancel, you should clearly state that you wish to cancel the service contract. You do not need to provide a reason for exercising an applicable statutory withdrawal right.

11 Your consumer rights

This policy sets out AgeWell’s standard commercial cancellation and refund arrangements. It does not limit any mandatory rights or remedies available to you under Irish consumer law.

Nothing in this policy removes your statutory rights.
If there is any conflict between this policy and a mandatory consumer right that applies to you, the applicable statutory right will take precedence.

Our purpose is to help older people, families and those supporting them better understand concerns, organise information, explore care and support options, prepare questions and identify appropriate next steps.

AgeWell is not a diagnostic, prescribing, treatment, emergency or substitute medical service.

The information and guidance provided by AgeWell must be understood within the scope and limitations described below.

01 What AgeWell provides

AgeWell provides independent nurse-led:

  • Care navigation
  • Information and signposting
  • Support to organise concerns and questions
  • Support to understand care and support options
  • Guidance on appropriate next steps
  • Preparation for conversations with healthcare professionals
  • General guidance for families supporting an older person

Areas discussed may include ageing, frailty, falls, delirium, changes in function, home support, independence, changing care needs, care options and navigating health and social-care services.

The purpose of AgeWell is advisory and educational.
We help you understand and navigate an issue. We do not replace the healthcare professional or service responsible for examining, diagnosing, treating or medically managing the person concerned.

02 What AgeWell does not provide

Unless expressly stated as part of a different service and within Caroline’s professional scope, AgeWell does not provide:

  • Emergency or urgent medical care
  • An emergency-response or monitoring service
  • Physical examinations
  • In-person clinical examinations
  • Medical diagnosis
  • Differential diagnosis
  • Confirmation or exclusion of a suspected diagnosis
  • Prescribing
  • Medical treatment
  • Surgical treatment
  • Medication initiation or discontinuation
  • Changes to prescribed medication doses
  • Replacement prescriptions
  • Interpretation of investigations as a substitute for a treating clinician
  • Continuous clinical monitoring
  • Remote monitoring of deterioration
  • Emergency triage services
  • Ambulance services
  • Hospital care
  • GP services
  • Consultant medical services
  • Pharmacy services
  • Physiotherapy, occupational therapy or other professional services outside our scope
  • A replacement for an existing care team
  • A substitute for an assessment by another healthcare professional where that assessment is required

03 No diagnosis or exclusion of illness

AgeWell does not diagnose medical conditions.

Information discussed during a consultation may indicate that further professional assessment would be appropriate. This does not amount to a medical diagnosis.

AgeWell also cannot confirm that a person does not have a particular condition or provide reassurance that symptoms are harmless where an appropriate clinical assessment would be required to establish this.

Where symptoms, signs or changes require diagnosis or medical assessment, you should contact an appropriate healthcare professional.

04 Limitations of remote consultations

AgeWell consultations are provided remotely.

A remote consultation has important limitations. Caroline cannot perform the same physical examination, direct observation, investigation or assessment that may be available during an in-person clinical appointment.

Guidance is therefore based on the information made available before and during the consultation and what can reasonably and appropriately be considered remotely.

Where an issue cannot be appropriately addressed remotely, Caroline may advise that an in-person assessment or assessment by another healthcare professional or service is required.

05 Professional nursing standards

Caroline provides nursing services within her individual professional scope, competence and professional obligations as a registered nurse.

Registered nurses remain professionally accountable for their own practice and must practise in accordance with applicable Nursing and Midwifery Board of Ireland standards and guidance.

The NMBI Code of Professional Conduct and Ethics for Registered Nurses and Registered Midwives applies to healthcare provided in person, virtually and through other platforms.

Nothing in this disclaimer changes or removes Caroline’s professional obligations as a registered nurse.

06 Emergencies & urgent concerns

AgeWell is not an emergency service.

Do not wait for an AgeWell consultation, appointment, email, message, callback or website response if someone requires urgent or emergency medical attention.
Emergency: 112 or 999

If someone is seriously ill or injured, deteriorating rapidly, experiencing sudden or severe symptoms, or you believe their life may be at risk, seek emergency medical assistance immediately.

Depending on the circumstances, it may instead be appropriate to contact a GP, GP out-of-hours service, pharmacist, emergency department or another appropriate healthcare service.

AgeWell email accounts, website forms and booking systems are not monitored as emergency communication channels.

07 Deterioration or changing symptoms

A person’s health or condition can change after information has been provided to AgeWell or after a consultation has taken place.

Guidance provided at one point in time should not be assumed to remain appropriate if circumstances, symptoms or the person’s condition subsequently change.

If a person develops new symptoms, deteriorates, becomes acutely unwell or their circumstances materially change, seek appropriate professional assessment rather than relying on previous AgeWell guidance.

08 Delirium, confusion & behavioural changes

AgeWell may provide education about delirium, confusion and changes in cognition or behaviour.

New, sudden or significantly worsening confusion or behavioural change may require prompt medical assessment.

Such changes should not be assumed to be caused by ageing, dementia or another known condition and should not be managed solely through an AgeWell consultation.

09 Falls & injuries

AgeWell may provide education and general guidance concerning falls, falls risk and falls prevention.

AgeWell cannot remotely determine that an injury is minor or exclude injury following a fall.

A fall involving injury, significant head impact, loss of consciousness, severe or increasing pain, inability to mobilise, new neurological symptoms, unusual drowsiness, significant bleeding or other concerning symptoms may require urgent professional assessment.

10 Medication & treatment

AgeWell may provide general education about medication-related issues or help a client identify questions to discuss with a pharmacist, prescriber or treating healthcare professional.

AgeWell does not prescribe medication or independently direct clients to start, stop, increase, decrease or otherwise alter prescribed medication or treatment.

Decisions concerning prescriptions, doses, interactions, contraindications or changes to prescribed treatment should be addressed by an appropriately qualified prescriber, pharmacist or treating healthcare professional as appropriate.

11 Test results, reports & clinical documents

A client may wish to discuss information contained in a medical letter, discharge summary, care document or investigation result.

Where appropriate within the scope of the service, AgeWell may help explain general terminology or help the client prepare questions for their healthcare professional.

This does not constitute formal interpretation of an investigation, diagnosis of a condition or replacement of advice from the clinician responsible for ordering, interpreting or acting on that investigation.

12 Photographs, video & other information

If photographs, video, documents or other information are considered during a consultation, they provide only limited information and must not be treated as equivalent to an appropriate in-person examination or diagnostic assessment.

AgeWell cannot guarantee that a photograph, video or remote observation shows the full nature, severity or cause of a clinical issue.

13 Accuracy & completeness of information

Guidance provided by AgeWell depends substantially on the information made available to Caroline.

Information may be incomplete, inaccurate, misunderstood, unavailable or may change after the consultation.

Relevant information that is omitted, unknown or inaccurate may materially affect what guidance can safely and appropriately be provided.

Clients should therefore provide information honestly and to the best of their knowledge and make clear where they are unsure about a fact or detail.

14 Family members & information about others

AgeWell frequently supports relatives and others who are helping an older person.

Where the older person is not participating in the consultation, AgeWell’s guidance is necessarily based on the information supplied by the person seeking advice.

A consultation with a relative is not an assessment of the older person.

It does not enable AgeWell to diagnose the older person, determine their complete clinical condition or make healthcare decisions on their behalf.

Clients should only provide information about another person that they are entitled to share and that is reasonably necessary for the consultation.

15 Autonomy, consent & decision-making

AgeWell respects the rights, wishes, privacy, autonomy and dignity of the person concerned.

A family relationship, payment for a consultation or involvement in someone’s care does not automatically give another person authority to make decisions for them or access confidential information about them.

AgeWell does not provide legal determinations concerning a person’s decision-making capacity or another person’s legal authority to act on their behalf.

Where legal or formal decision-making issues arise, appropriate professional or legal advice may be required.

16 Care options, services & providers

AgeWell may provide general information or signposting concerning care options, home support, community services, residential care, healthcare services or other supports.

Signposting to a service, organisation or professional does not guarantee that the service is appropriate, available, accepting referrals or suitable for the individual’s circumstances.

Unless expressly stated otherwise, mentioning or linking to a third-party organisation does not constitute an endorsement or guarantee of that provider.

Clients remain responsible for satisfying themselves as to the suitability of any third-party service they choose to use.

17 Funding, grants & service eligibility

AgeWell does not determine eligibility for public or private funding, grants, benefits, healthcare schemes, home-support hours, residential-care funding or other services unless AgeWell is formally authorised to make such a determination.

Eligibility, availability and funding decisions remain with the relevant authority, service provider, insurer or decision-making body.

AgeWell cannot guarantee that an application, referral or request will be approved.

18 Referrals & recommendations

AgeWell may suggest that you consider contacting a particular type of healthcare professional, service or organisation.

Such guidance is intended to help with navigation and does not necessarily constitute a formal clinical referral.

Where a formal referral is required, this may need to be completed by a GP, consultant or another appropriately authorised healthcare professional.

19 Care plans & professional assessments

AgeWell may help clients understand existing care arrangements, organise concerns or identify matters that could be discussed with relevant professionals.

Unless expressly agreed as a specific professional service, AgeWell does not assume responsibility for another organisation’s care plan, risk assessment, clinical assessment, treatment plan or statutory assessment.

The healthcare or care provider responsible for delivering a person’s care remains responsible for its own assessments, decisions, policies and services.

20 No guarantee of outcomes

AgeWell aims to provide helpful, professional and appropriately scoped guidance.

However, AgeWell cannot guarantee:

  • A particular health outcome
  • Improvement in symptoms or function
  • Prevention of illness, deterioration, injury or hospital admission
  • Access to a particular healthcare professional
  • Access to a particular service
  • Availability of home-support services
  • Admission to or availability of residential care
  • Approval of funding, grants or benefits
  • A particular decision by a healthcare provider or public body
  • A particular timeframe for accessing services

21 Decisions following a consultation

AgeWell aims to help clients understand information, consider options and identify appropriate questions or next steps.

Where a decision requires medical diagnosis, clinical examination, prescribing, legal advice, financial advice, formal assessment or input from another regulated professional, that decision should be addressed with the appropriate professional.

AgeWell guidance should not be used to delay or avoid seeking appropriate professional assessment.

22 Follow-up & ongoing monitoring

Unless specifically agreed, an AgeWell consultation is a standalone advisory service and does not create an obligation for AgeWell to continuously monitor the client’s or older person’s health or circumstances.

AgeWell does not assume responsibility for identifying changes that occur after the consultation.

Clients should seek further advice or appropriate healthcare assessment if circumstances change or further concerns arise.

23 Technology & communication limitations

Online consultations depend on functioning internet connections, devices and communication platforms.

Technical difficulties may affect audio, video, communication quality or the ability to complete a consultation.

If technical limitations prevent a consultation from being conducted appropriately or safely, AgeWell may pause, reschedule or discontinue the consultation and recommend another means of assessment where appropriate.

24 Website, social media & general content

AgeWell’s website, social-media content, articles, posts, downloadable resources, videos and other general educational materials are provided for general information and education.

General AgeWell content is not personalised clinical advice, a diagnosis or a substitute for individual professional assessment.

Reading, viewing, downloading, liking, commenting on, sharing or otherwise interacting with AgeWell content does not itself create a nurse-client relationship.

25 Search engines, AI & third-party summaries

AgeWell cannot control how search engines, artificial-intelligence services, social-media platforms or other third parties summarise, reproduce or interpret information published by AgeWell.

A summary or answer generated by a third-party platform should not be assumed to represent the complete or current AgeWell guidance.

Where information is important to a health or care decision, users should refer to the original AgeWell material and seek appropriate professional advice where required.

26 Training, talks & organisational services

AgeWell may provide talks, education, training or consultancy to nursing homes, healthcare organisations, community groups, businesses or other organisations.

Unless expressly agreed otherwise in writing, educational or training content is general in nature and does not replace an organisation’s own clinical governance, policies, procedures, risk assessments, legal advice or professional responsibilities.

Organisations remain responsible for ensuring that their own practices comply with applicable law, regulation, professional standards and organisational requirements.

27 Professional accountability

Nothing in this Clinical & Advisory Disclaimer is intended to exclude, avoid or reduce any professional obligation or duty that applies to Caroline when providing professional nursing services.

Nothing in this disclaimer is intended to exclude or restrict liability where doing so would be unlawful.

Nothing in this disclaimer affects any statutory or other right that cannot lawfully be excluded or restricted.
